2009-02-27 延命治療と刑事責任というパターナリズム
_ 昨夜のブログで「野菜を食べろ」というパターナリズムについて書いたら，今朝の新聞に「延命治療」の話題が一面にでていた。
内容は，救急医学会の調査にもとづくもので，「終末期」と診断された患者さんが「人工呼吸器の取り外しや投薬中止」にいたるまでの手続が，わかりやすく図示されているもの。０７年に日本救急医学会の特別委員会がつくった終末期医療に関するガイドライン（指針）に沿って，延命治療を中止した場合（家族らの同意をえた場合でも），現在の法制度では，刑事責任を問われることがある，という。
この場合には，医療現場が作成したガイドラインというパターナリズムと，刑事責任という法制度にもとづくパターナリズムの激突である。いずれも，「公共性」をめぐる大問題である。この問題を細かく分析していくと際限がなくなるので，ここでは原則的なことだけを取り上げることにする。ここで問題になるのは，家族の同意が得られてもなお刑事責任が問われる可能性がある，ということだ。この場合の「正義」は民意だという。つまり，家族も医師も納得して「延命中止」をしても，民意によって定められた法制度が「ノー」といえば刑事問題になる，というのだ。つまり，当事者以上に「民意」という「公共性」が優先される，これも一つのパターナリズムである。ここでは，個人の意志や感性や情緒の問題はいっさい無視されてしまう。しかも，それが「民意」という「多数決」原理で支配されてしまうところに大きな問題がある。
臓器移植の場合の「脳死」を「死」と判定するガイドラインが欧米で承認されるようになったのは，「民意」という「多数決」原理にもちこんで，それが成功したからだ，と聞いている。わたしの疑問は，人間の生死にかかわることがらを「多数決原則」にゆだねてしまっていいのか，ということだ。同じことが，裁判制度の改革にともなう民間人の登用がいま大きな話題になっている。ここでも「民意」という「多数決原則」が採用されている。つまり，「公共性」の問題だから，すべて「多数決原則」にゆだねるべし，というパターナリズムが社会の，あるいは個人生活のすみずみまで浸透していったら，生身の人間の居場所はなくなってしまうだろう。
すでに，教育現場でも同じような問題があちこちに持ち上がってきている。数量的効率主義に毒されてしまった教育は，もはや，人間の心身まで管理することになってしまった。しかも，数量的に合理化できない要素はすべて「切り捨て」である。わたしに言わせれば，人間の「半分」だけに光を当てて，あとは「知らぬ勘兵衛」である。
ああ，だんだんと書いていること自体が辛くなってきた。これをこのまま書き続けるとわたしの気分まで落ち込んでいってしまいそうだ。
結論を急ごう。公共性の問題はたしかに重要である。だから，われわれが社会生活を営む上で，必要最小限内に「公共性」というパターナリズムを封じ込んでおくことが大事だ。つまり，われわれがコントロールできる範囲内で。あとは，個人の自由裁量にゆだねるべきだ。
「民意」という名のもとに国家権力が，個人の基本的人権にかかわる問題にまで口出しするようになることの恐ろしさ・・・パターナリズムの怖さはそこにある。
すでに，ジョウジ・オウエルが『１９８４年』という小説のなかで，もののみごとに私生活まで国家が管理する社会を描いている。起床時間から顔を洗い，体操をして，食事をする，それらの内容まですべてのメニューが国家によって決められていて，しかも，すべてテレビ・カメラによって監視されている人間の悲哀を。
そういう波がいまじわじわと押し寄せてきている，とわたしは肌で感じている。だから，パターナリズムということばが好きではないのだ。
しかし，よくよく考えてみるがいい。近代スポーツはまさにスポーツの「パターナリズム」の最先端を走った文化ではなかったか。そしていま，その名を「グローバリズム」という衣に着替えて，新たなスポーツの「パターナリズム」を進展させている，とわたしの直観がそう教えてくれる。サブイボが立つほどに。この皮膚感覚の方をわたしは大事にしたい。そして，信じたい。理屈以前の問題として。
